नमस्कार दाजुभाई तथा दिदी बहिनीहरु।

आज बिहान निक्कै तनाबमा उठियो। कारण, हिजो राती employer को automated system ले email पठायो "तेरो work authorization December 24 सम्म मात्र रहेछ, छिटो update गर् नत्र employment termination हुन्छ" भनेर। अब मेरो screen name ले नै सबैलाई थाहा भैसक्यो होला म कत्तिको पिडित् मान्छे हो भनेर। दिक्क लाग्छ कहिले काहिँ एत्ती धेरैको कागज बनि सक्दा पनि आफ्नो चाँजो पाँजो छैन। त्यही TPS ले गर्दा OPT छोडेर त्यसमा काम गर्दैछु। अब यो पनि कहिले extend हुने हो कि नहुने हो केहि अत्तो-पत्तो छैन। करिब् ४ वर्ष नाघ्यो यो IT मा काम गर्न थालेको। पैसा पनि राम्रै कमाइयो। न त H1B पर्‍यो, न त कसैले EB2 नै apply गरिदियो, न त EDV नै पर्‍यो। Asylum पनि try नगरेको कहाँ हो र? त्यो नि परेन। भाको girlfriend सँग नि बिछोड भाको करीब १ वर्ष भयो। अब यस् लाई कर्मले ठगेको भन्दा अतियुक्ती होला र? आफन्तले ताना मार्छन् "Green Card भाको केटी खोजी दिन्छौ, बिहे गर्" भनेर। अब लगनगाँठो जस्तो कुरो त्यै हरियो पत्ता कै लागि गर्ने हो र? यत्तिको qualified छु, अब आएर त्यसैका लागि घरजम गरेर बस्नु? स्वाभिमानि मान्छे, मनले मान्दैन। तनाब छ हजुर, निक्कै तनाब छ।

साथी हरु, के यो TPS extend होला त? भए पनि कहिले सम्ममा notice पठाउला त USCIS ले? केही जानकारि छ कि यहाँहरु सँग? कृपया सहयोग गरिदिनु पर्‍यो यदि छ भने।

TPS expiry date ko 2 months agadi (around Oct 21) decision aaunchha bro per DHS website. Very unlikely that it won't be renewed, at least once.

Let's say they granted the extension for Nepal, how long will it take for us to get our EADs updated? Any idea guys? Some say EADs get updated automatically and sent to you in the mail since the USCIS wants you to have the EADs before the existing one expires.

I think it would automatically extended for some months but one has to apply on time. It will be published in the federal register and it will clearly tell the procedure in case it gets extended.
but hope so.

USCIS will published notice on Federal register about Re Registration about TPS4Nepal atleast 60 days before the current expiration date of December 24,2016. Even they don't renew TPS for Nepal for 18 months more, which is most unlikely as per the past history of all TPS countries provided by USCIS , they would issue the notice of Termination for TPS for Nepal atleast 60 days before the current expiration date but every individual who are currently on TPS status would have 6 months time period to return back to their respective original status they previously hold before. currently there are 13 countries on TPS status including Nepal .

Every country has been renewed atleast once after the DHS has been formed in 2002 according to the immigration and naturalization act which designates , redesignates, renews and cancel TPS for any country. Before DHS , US Department of Justice , (INS) Immigration and Naturalization service used to handle TPS for any country. US Department of Justice have designated 23 countries on TPS till now and 13 countries is still on TPS Status.

But every country which has been designated TPS was renewed atleast once . if the situation improves in the respective TPS country such as civil war in Rwanda, Burundi and Bosnia Herzegovina TPS was terminated by Dept of Justice at the end of civil war, but when it comes to Natural disaster such as Hurricane and Earthquake in Honduras, El Salvador and Haiti, TPS has been renewed for more than a decade almost 17 years for Honduras , 15 years for El Salvador and 6 years for Haiti because the reconstruction and redevelopment takes many years for any respective country.

Sierra Leone, Liberia and Guinea was designated TPS due to epidemic such as Ebola virus . Those countries was renewed for only 6 months after the TPS expiration date even though Ebola was completely eradicated from those countries. So I think Nepal has very high chance of getting renewed with the past record of TPS provided by US Dept of Justice in the past and currently by DHS/USCIS which took over the responsibility of handling TPS for all countries.

Automatic EAD extension would be valid for 6 months. Example if USCIS renews TPS4Nepal for 18 months they will issue notice on federal register and publish it in USCIS website before 60 days of current TPS expiration date and on that notice it would be clearly mentioned that the current TPS EAD which all Nepalese hold expires on December 24, 2016 and that federal register notice is an evidence for all employers in US that EAD which expires on Dec 24 is still valid for 6 more months during which all Nepalese would get new EAD with the new expiration dates which is TPS expiration date, and that notice provided in federal register is evidence to all employers in US ,so they never can questions about your work authorization in the United States. FEDERAL REGISTER NOTICE is an EVIDENCE FOR NEXT 6 MONTHS for EMPLOYMENT AUTHORIZATION DOCUMENT to all employers in US.

I have done extensive research about Temporary Protected Status, so all the information provided above are true to extend of my knowledge and authentic with the information provided by US Dept of Justice, DHS and USCIS. I would be more than glad to share all my information and knowledge about TPS to all the readers here in Sajha , if you have any questions regarding it.

USCIS estimates that there are around 10,000-25,000 Nepalese in US currently on TPS status .. Every Nepali have some questions and queries about TPS status because it's very complicated status which don't have detailed information covered in the USCIS website , so I think Sajha could be the best online forum to share , collect and gathered information about TPS among all the Nepalese users of Sajha.com

I think this is best platform and time to discuss about re registration about TPS4Nepal .. Such as procedures, documentation and discussing personal queries about individual cases for TPS.

USCIS would allow only 60 days for re registration time period this time not 180 days like during the initial registration period, so time would be very limited to all the Nepalese who are currently on TPS status and want to renew the TPS if USCIS extends for next 18 months .

So I think all Nepalese should Unite to help each other to share information about TPS

Statuspidit, what happens if you are in a good status and apply for asylum but it gets rejected. Do they deport you or you can stay until you have a good status?

I had applied for asylum too when I was on F1. It got rejected so I was back to F1. So, I'd say if your asylum gets rejected, you will fall back to the previous status that you held, unless you had none then the case goes to the immigration judge. This is what I know bro.

Destruction from earthquake and eradication of a disease two very different things rural ji. Nepal ma earthquake recovery/reconstruction is almost nil. Very likely to get extended at least one time. We should find out by late October.

ruralok - Which country are you talking about? I dont see any country's tps expiring on Nov. i checked at USCIS website.

In my research, there are multiple factors that affects the designation and extension of TPS.

1) The first factors is, the affected country should officially ask DHS to extend or designate (in out case re-designate) TPS. In our case, Nepalese embassy is doing great in this matter. Moreover, the relationship between country seeking TPS and the US government should also be very pleasing. Philippines also made petition to the US government because of the huge hurricane, but US government still did not designate TPS.

2) Another factors is the current condition of the country. The secretary of DHS should give reasons on extension, re designation or designation of TPS in the particular country. Otherwise, senate or other government or non government may question him/her.

3) Economic condition of the country also plays important role on extension and designation of TPS. DHS is extending the TPS for Haiti for the economic condition of the Haiti.

4) One of the prominent factors is, if the number of TPS holder is very high, it is very likely that the TPS will be extended forever. The main reason behind this is the economic benefit the US getting. See the Elsalvador. The number of TPS holder from Elsalvador is more than 50,000. So they are keeping extending it.

USCIS have published the notice for Liberia, Sierra Leone and Guinea about extended 6 months for orderly transition before termination on May 2017 on their federal register on September 22,2016. which clearly states that TPS won't be renewed for those countries after May 2017, USCIS provided 6 months extension for smooth transition to return back to their original status they previously maintained during the application of TPS and if the status have been previously expired , USCIS informed them to prepare and arrange for the departure from the United States within that time frame.

Regarding TPS 4 Nepal, USCIS would publish notice on last week of October, 2016 on their USCIS website, which would be most likely to be extended for next 18 months, in worst case scenario, if USCIS doesn't extend TPS for Nepal , all the Nepalese currently holding TPS status in US, would have additional 6 months of orderly transition before termination of TPS on June 2017.

So to avoid that circumstances for all the Nepalese currently holding TPS status in US , we all Nepalese here in US need to unite, sign and share the petition to request US Government and its different federal agencies such as US Department of State, US Department of Homeland Security DHS and United States Citizenship and Immigration Services USCIS to extend TPS 4 Nepal for next 18 months by signing the following petition and sharing to all your friends, families, relatives, neighbors currently in US via posting in your facebook posts.

Our 1 min of effort can change the lives of many Nepalese here in the United States.....

Tps will be extended...its just been a year and half. Just wait until the 24th of this month and the extension will be anounced. Donot believe on negative stuff posted in here because that doesnot sound true. It will be extended at least few more times and thats how it works.
