 New F-1 Student Rule Takes Effect September 15, 2026

Beginning September 15, 2026, a new DHS rule is expected to replace “duration of status” for F-1 students, J-1 exchange visitors, and I-visa media representatives with a fixed expiration date on Form I-94. Those who need additional time must apply for an extension with USCIS or leave the United States and seek readmission. The rule also creates new restrictions on school transfers, changes of major and educational level, reduces the general F-1 grace period from 60 to 30 days, and limits most initial F-1 and J-1 admissions to four years. Current D/S holders who remain in valid status and do not travel will receive transition protection.

New rule

“D/S” will be replaced with a specific I-94 expiration date.

Because the I-94 will contain an exact date, unlawful presence can begin after that date unless the student timely files an extension or obtains another lawful status.

Some students will need to file both Form I-765 and Form I-539 when OPT extends beyond their fixed I-94 admission period.

Grace Period Reduced from 60 days to 30 days for students admitted under the new fixed-date system. Transition students generally keep the 60-day period.

ALERT:

Current F-1 students admitted for D/S who are traveling in Nepal should return before September 15, 2026, if they want to preserve the transition protections. Students who return on or after that date will generally receive a new I-94 with a fixed expiration date. They should also carry updated financial-supporting documents to present to the officer if requested.
